Do MTN CHARGE R21.93 (+vat) per MB for VOIP ( SKYPE etc ) CALLS?

According to MTNs website :http://www.mtn.co.za/?pid=232081 ( Terms and Conditions ) :

In terms of the current regulatory regime in South Africa, please note that these tariffs and the MTN GPRS, GPRS+, EDGE or 3G technologies may not be used to transfer or generate Voice over Internet Protocol (VoIP) traffic. Should it be found that VoIP traffic was carried over the MTN network using these tariffs or technologies, MTN reserves the right to cancel the agreement that you have with MTN, with immediate effect. You will also be charged retrospectively at R21.93 per Megabyte (VAT excluded) for any VoIP traffic transferred by such means.

They say:

As far as I know ICASA has dropped that legislation and VOIP is LEGAL since February > so why is this in MTNs conditions????

Are you guys serious about charging that way MTNBB ?????

I have asked this question a while ago but dont remember a reply from you. Maybe you did reply but i cant find it...PLEASE COMMENT.

Or anyone else who knows how it works...any experience>>please comment.

This bothered me quite a bit when having a look at the MTN website a few days ago. Would love to get some feedback on this as I am currently considering a move from Vodacom to MTN for some DATA applications.

Hang on...MTN is a licensed provider of Voice Services, If I use my MTN data service for voice, how can that be contrary to the current regulations? It's not like I'm using an unlicensed voice operator like a Wisp. I don't think that MTN can get this to stand up in court. Also, if I'm using prepaid, how are they going to stop me?

Its a major put off for me, not so much because of VOIP but rather the attitude and the presumption that they can dictate your usage.

BUT

Let me save my opinions until MTN replies to the thread.
