there have been rumours....can you give more details

- were you operating under a VANS licence?
- what did they say?
- how exactly did they shut you down?
- was it telkom or icasa? were there any cops involved?
- can you remember any of the names of the people involved?

Yea, as far as I know if you have a VANS license you are allowed to operate as a WISP on ISM bands.

that depends who you ask and the majority answer will be they are not

Do you mean that your ISP has suspended your service or did they take
your equipment from a highsite?

Hi,
Unfortunately no, we did not have a VANS licence, we were told in the beginning that having a VANS would not help. But now i believe it actually does help. Apparently after speaking with the legal dept. of Telkom in Bloem, they say that icasa is unable to controll the amount of ilegal wisp's in the country now so icasa have thrown the ball back into Telkom's court now saying that bacause most of the ilegal wisp's are using adsl to feed their wireless networks, Telkom must now start disconnecting these dsl lines. (Very clever move!)
Our equipment is still up and running. Telkom has just suspended our line.
I cant remember any of the names involved. I have the original fax that was faxed to me on the 21st, one day before they shut us down.

Stan.

I have a real issue with this...ICASA is the regulator. Telkom is the monopoly. The regulator cannot ask the monopoly to close down COMPETITION. F@ck this gets me irate!

Why don't you use the satellite companies I posted elsewhere ? To expensive etc ... ? Stan since Icasa won't even bother to take your equipment doesn't this enforce my point that they also won't rip up 200 residences copper wire connected to a DSLAM.? And Peopod your argument concerning Icasa has
been my point the whole time. Telkom can't confiscate anything, their
mongrol mut Icasa does this for them. This point is lost on www.antitrust.co.za

Yup, this is bloody frustrating!

The left hand blames the right hand and visa versa. It sounds like to me that nobody actually knows what the heck to do any more.

Anyway thanks for the feedback guys. I think that i am just going to find another feed. These poor farmers who do not have any form of Telkom comms. running to their farms have really been enjoing having internet for the past 4 months. They are all pretty upset with us at the moment.....

The saga will continue...... :)

Stan.

All they are doing is perpetuating the denial of affordable communications in SA.

They've done such a good job ****ing everyone over so why stop now.

We need to **** them back.

Thats total BS!!!!!!!

Are there any legal charges against you? I want to share costs of ADSL with my neighbors, but dont want 2 end up in court...

thOrn highly unlikely. You are not advertising anything and who will tell
Icasa or Telkom? The wisps got nailed because they were openly advertising their
wireless service.

Nope, our local isp here layed a complait against us. Icasa came down to investigate us, took a few photos, asked us if we had invoiced anyone yet, then left.....
It was only Telkom who took further action because icasa told them that it was because of the adsl lines that wisp's were surviving!
At present we dont have any charges against us. But we will now have to lay low for a while :-)

Wolf in sheep clothing

You see, this is the problem. The main enemy is not so much Telkom, as it is your fellow ADSL forum members, existing ISP's who put the pressure on Telkom, as clients of Telkom, to close the WISP's down. They lose clients and business. We had the same problem in a small rural town. A local ISP gallopped to Telkom in tears about losing customers and screaming at them to do something about it

Never mind the fact that we were giving a vital service, where before, there never existed a service in the first place. These ISP's don't care about their customer's high telephone bill's and poor quality dial-up connections, they just care about their pocket. Never mind the fact that farmers must spend up to 1 hour to do 1 internet banking transaction via a dial-up internet connection. The enemy is within!

Did they actually cut your line or suspended your isp account?

Who does Telkom think they are? They can't enforce the Law according to them! It is Icasa's job.

They can only frustrate us and make us more desperate. The wisps must stand together NOW!

The ISP's are too scared to get involved with Wireless Internet because they are all depended on Telkom for thier bandwith. This is the new technology and those who aren't in it now will be left behind!

I presume your antenna is mounted on a tower? If so you are stuffed, Icasa can
obtain an order to seal it with a plastic bag. If you touch it you are violating a court
order. In dense residential areas Icasa can't do much against a mesh. I doubt
they will waste their time sealing parabolics on people's roofs. You are in a rural
area so you are an easy target. I believe dominic would have the answer, but you would have to pay him. Very few people know how the lawyers give Icasa the run-around. This would be a closely guarded secret. ;)

yeah yeah always good for a dig and a chuckle....stan first thing to do if you want to have a business is to download the VANS licence application from the icasa site and submit it...cost of approx R5 636..this is not a guarantee and it is debatable whether it allows you to provide wireless internet access on the ISM bands but it does seem to offer some level of protection against interference; best prize would then be to get a frequency licence outside the ISM bands as well but these are damn expensive and hard to come by

then look at your options for sourcing bandwidth from someone other than teklom - i know it all goes back to them eventually but if you are not directly connected to adsl then it is far more difficult for them to switch you off

but try and get the VANS licence first - without this you are very vulnerable to confiscations and even criminal charges

Thanks for the advice Dominic.
I believe though that icasa has put all vans applications on hold till the new operator comes into play. So it could take a while.

interesting - my info was that they had started issuing them again after the new terms and conditions were released...can you share more about where you got that

until the new operator comes into play - "a while" is probably a gross understatement

i will see if i can find out the current status from icasa
