TelkomSA is Spamming its Own Customers ( and in Breach of the ECT Act )

TelkomSA is currently SPAMMING ALL of its customers who host mail with them ( even those with personalised domains )

The email is advertising its PC Package deal.

Now here is the fun part ...

The 2002 Electronic Communications and Transactions Act stipulates that
"Any person who sends unsolicited commercial communications to consumers, must provide the consumer with the option to cancel his or her subscription to the mailing list of that person"

"Any person who fails to comply with or contravenes subsection (1) is guilty of an offence and liable, on conviction, to the penalties prescribed in section 89(1)."

If you attempt to unsubscribe using the email address provided - your unsubscribe attempt bounces back ...

"Warning: undefined mail delivery mode: normal (ignored).
The users mailfolder is over the allowed quota (size). (#5.2.2)"

As a result TelkomSA are in clear breach by not providing a means to unsubscribe !
 
Hahaha ROFLMGO. They can't even sort their own mail out. This from a "service" provider?
 
Umm, I'm not 100% sure, but AFAIK if you have done bussiness with a company they are allowed to send you email (or SMSes) and it is not unsolicted.

Hence Telkom is acting quite legally if they are are sending to contact information you have provided them with when you sign up for an account with them.

only if you have indicated that you are happy to receive their marketing crap and they still have to provide a valid unsubscribe and thereafter not send any more

in this case it looks like it would be argued that it is a valid unsubscribe which is not functioning for other reasons

keep a copy of the unsubscribe mail
send again after 24 hours
and again until it gets through

and if they send you more spam then go and lay a charge - will happily guide the process gratis just for the joy of telkom bgeing the defendant in a criminal prosecution for once (as opposed to getting the SAPS to prosecute others)
 
LOL, as i read postmanPot's post the gostbusters tune came to my head, HAHAHA, Who u gonna call?!?! ICASA.

Hopefully they can work as well!
i have totally lost it ! :(
 
I unsubscribed from this service a few months ago, but they're still spamming me.
