Why not? It may be too late to stop the law from going into effect, but the ConCourt can still reject any unconstitutional law. This kind of comment may also get the ANC to rewrite it so it passes muster.

Far from it. The law is still in it's preliminary stages of legislation. It'll probably take at least a year to get passed, at least. And even then, the Constitutional court can still rule it unconstitutional.
