SA ADSL blacklisting warnings: Bullying tactics?

Lol @ Afrihost -- oh wait im on afrihost..

This **** stupid notices started since uncapped became available ...
 
I'm quite glad actually, the worst thing that could happen to our entertainment industry would be it considered to be a pirate state.
 
What's worse?

1) A guy sitting in his house downloading a movie without paying for it (which he may or may not already own on DVD or have seen in a cinema or which he can rent or borrow from a friend fairly easily)

or

2) A media company that employs a third party company to spy on internet users and harvest private data from them without their permission often using methods that can be considered hacking, then sends them threatening letters without any due process or proof of guilt and employs lawyers to force these "criminals" into paying exorbitant amounts as settlement for an "infringement" which has neither been investigated or recorded by any law enforcement department.
 
Or 3) Syndicates who hire vendors to sell pirate movies tax free and funding other underground activity.

I'm not saying I condone piracy, just those who profit off it
 
So IS says to the ISP "Hey dude, your client is downloading piracy from a watchdog (hired by anti-piracty ppl) who was seeding pirated stuff. Dont disconnect the client, just let him know that some one overseas knows.". So then Afrihost message the user and say "Hi, we are going to disconnect you because IS says we have to unless you stop downloading piracy. We have no way of knowing if you are really downloading piracy, but the pressure is too great to take the chance."

Honestly, IS would never stop selling b/w to a big client just because of some random emails from random lawless anti-piracy groups.

stop using torrent (use filesharing service rapidshare etc...)than ISPs will never figure out what da hell are you doing :-)also VPN is good solution as well :-)....Internet is getting worse in south africa...what a pity!!!
 
While these notices from copyright agents continue to have zero legal standing in SA they should be sent back to the senders with a warning that even reading the contents of the notice by a local ISP could be considered illegal monitoring and a violation of the law.

If you ever read any of those notices you'd see that it only has an IP address of the offender (which is not rocket science to work out) and the alleged copyrighted work. So what you are saying is that anyone that uses P2P (which will reveal your IP and the files you are downloading) is invading privacy? Furthermore what I don't understand is how one can blindly turn away from an AUP that everyone agreed to? Just by "using" your connection you are bound to these terms... If the AUP states "Thou shall not copyright", and they catch you, why are you upset?

Also, reading the mentioned BayTSP's faq (http://www.baytsp.com/faq.html) it clearly answers questions on HOW they do it, WHY they do it and how they fit in the picture.

In a nutshell all this article shows is the ignorance of people that don't want to play by the rules and find it sensational to move the focus away from people whom really ARE breaking the law to someone that is preventing it from being broken.

Basically "they do not verify that the subscriber is actually guilty of copyright infringement before sending out warnings to their subscribers or reseller ISPs" therefore they can't ban you without providing evidence that they were monitoring your actual content. CAtch 22 situation.

But it would be interesting to know whether IS provides account holders information to the companies? eg Physical addresses.
 
IF you merely just serving notices from your upstream provider Internet Solutions. Why you adding some extra wording then?

rofl @Meintjes what a tit.

PS they have better things to do like hunt down spam gangs and child porn rings. because didn't you know they are A super secret government agency.
