Tina Sherman is suing McDonald’s for US$3 million.
The reason is that, according to Mrs Sherman, pictures of her butt naked were posted online by McDonald’s employee(s) when her husband left his cellphone at the McDonald’s in Arkansas, USA.
He asked the staff members to please secure the phone until he could retrieve his mobile device.
Tina claims she is being harassed. In fact the harassment got so bad they had to move.
McDonald’s must now pay up for all this pain and suffering and the Sherman’s think an amount of US$3 million will suffice.
Can the Sherman’s win?
The case will hinge on being able to prove that it was a McDonald’s employee who uploaded the photos. If they can do this then the Sherman’s can argue that it was an invasion of privacy.
Should they win?
Whilst I’m of the opinion that stupidity should be punished I am also of the opinion that the law needs to protect citizens from this kind of thing.
There’s no doubt in my mind that it’s incredibly daft in this day and age to send nude photographs of yourself around, even if it is to your husband’s cellphone.
These types of pictures are notorious for somehow being leaked and the damage is untold.
But if it floats Mr. Sherman’s boat then so be it, but he’ll have to learn to be a little bit more careful with his cellphone in future.
For me what’s interesting about this whole debacle is the amount involved. In South Africa it is difficult to break the R1 million mark when claiming damages. In the US the courts are not shy to slap a company with a huge fine.
