Legal action against Telkom

I wrote an earlier thread regarding this.

On 18 September I requested for a downgrade from ADSL 384 to ADSL 192. The technician apparently did this, but I am not sure, since the helpdesk operators still sometimes think I am on 384. Anyway, the technician did not register on one of "three systems" that the task has been completed.

I want to stop my Telkom internet account, but nothing can be done before that task is indicated "completed" on all their systems (on two of the three systems it shows "completed"). Nobody can complete that old task for me on the outstanding system, and hence it is impossible to stop the account, or to edit my acoounts in any other way.

On helpdesk computers it shows that the task has been completed, and as soon as they try to stop my internet account, some other system blocks them, because there is an outstanding task.

It is completely impossible to stop my account. We phoned for many hours, talked to many operators and managers etc. etc., but we cannot stop the account.

My only option is legal action, IMO. I have no other plan - tried them all. Does anyone know how to do this? What is best route to take? The small cases court maybe? Does anyone have a number/fax/address where a lawyer can send them a legal note?

I am desperate. I hope that this legal action may set an example and that people will sue Telkom in their thousands in the small cases court. That will teach them a good lesson if the court decides in my favour, and it will encourage many more to do the same.
 
Not to sound too negative, but the country being what it is and telkom being who they are, you have to make sure that you have enough money to counteract the lawyers telkom has with your own lawyers.

Dont you think the petty cases court is an option? With a good-natured judge things may turn against them, and if many people sue them , they cannot afford to send their top lawyer to thousands of court hearings. My hope is that I am lucky in the petty cases court, and then many more legal action will follow from other disgruntled customers. And yes, let them send their top lawyer to my small court hearing, and maybe he will pizs on helpdesks heads for letting him do that crappy work.

Take the CEO to small claimes court. He must pitch up personally, or lose the case. I'm not a expert, but it sounds like a plan.

Anybody knows of another way?

Thats a good plan, if it is not thrown out of court ...

Hi there. My account was stopped at last. Thanks for all the help. I had to move so high up the food chain to get this done, that my next stop was none other than Kofi Annan.

Kofi has has no more, begging for donations, try the welfare Hehe
