Hey Guys,
My mom's in a bit of a pickle.
She is currently in the process of closing down her own business, which she's been running for the past 16 years.
So what I'd like to know is, can she claim UIF until she finds a job?

Sorry i forgot to mention, she's been paying her UIF ever since she started the business.
Then I cannot see why not - otherwise why was she paying it?

Well apparently her accountant was saying she can only claim if she got retrenched or was fired. Voluntary closure will not be paid out by UIF.

Well the best is she applies for UIF and sees what happens. The department of labour handles this but being up in Jozie (I assume your mom is there too), it could be a bit frustrating. Else her accountant could advice her as well.
The UIF claims conditions change so fast that its hard to say if she qualifies or not.

Nope, no longer. We fired one of my wifes staff in Novemeber and she could not claim from UIF - she was pissed, teaches her to steal. I know retrenchment is possible.

Then why did she pay UIF at all then? Surely as a business owner she could never be fired or retrenched? Maybe her accountant should have told her that 16 years ago...or whenever UIF started.

UIF changes have been as a result of the world recession. Claims conditions will improve in the future when we experience more job growth. UIF contributions is anyway now compulsory.

Don't I know it. UIF is a scam and rip off. I am a business owner and MUST pay UIF...which I can never claim. Is that fair, legal and even constitutional? Have you studied the UIF claim conditions? They make it nearly impossible to claim...

Everytime my wife losses a staff member, we consult her labour dude. It changes each and every friggn time. We just pay up (UIF). One of my ex-bosses did not pay UIF for two years so I know of the repercussions if you don't.
We have a nanny who we will keep for another 2yrs and then let her move on. We will "retrench" her on paper just in case she cannot find work.

We have the same issue with our nanny. I did some research after she was with us for a year...she could claim something like R112 per month...her salary was R2800.

Besides being the owner is she also a normal staff member with an employment contract, receiving a monthly salary?

She was a sole trader. So she took all profits. She needs the cash to keep her going till she finds a new job.

Yeah, that changes it. If it was a CC then even though she is a member she could still be employed by the CC - my wifes setup
