ISPA Lodges Complaint against Telkom with Competition Commission

ISPA finally begins to wake up. What ??? Is it bonus time of something ?
We've been waiting for an organised reaction from this organisation for so long now ...
NEWAYS - better late than never.
 
Excellent news. So far the competition Commission is the only organisation that has done something for consumers and had the balls to tackle large organisations(including state-sponsored monopolies). In the last month alone, two major victories for them - SAA and the motor industry. Unlike ICASA they can also llevy penalties.

If the ISPA wins, expect some serious penalties. And like Comair is doing to SAA now, take the monopoly to court to obtain satisfaction for the damage caused.

This will be a long case(SAA even tried to ensure that their MD was not reachable), but in the end could very well be the start of the decline of Telkom, because it will hurt them where it hurts them the most- their greed!

I also wrote in another thread that I belive that in the case of a finding such as in the motor industry, we as normal civilians should be able to launch a class action suite to claim the monatory injustices that the monopolistic organisation has caused us.

This is simply great news to hear and with ICASA regulations to be implemented soon, Telkom arn't going to be very happy.
 
ICASA merely has to write a regulation that stipulates a fine for this & that, and no doubt once [not] signed into effect by her Poisonous Ivyness, ICASA can then [not] impose fines...

Can ICASA (being a public company) justify what they have done since they started? I would like a breakdown of - Task,Timeframes,Costs and outcomes... just so I can see how much of my cash is being spent on what tasks...

Wonderful, but why only now?
When this eventualy gets to any form of judgment/closure, another 2 years would’ve gone by. Then Telkom will just tell them to sod off anyway.

By that time the ISP's (the ones that are left in business) will be begging Telkom for mercy and Icasa will be cowering in the corner like a puppy that has just been smacked after pissing on the carpet.
There is no guarantee that the LLU will actually go ahead in 2 years time either. That’s the target date, remember the SNO is 4 years overdue and Telkoms little reign of evil has been extended before.

Take the bandwidth landing rights and the cables away from these economic gunmen and unbundle the loop NOW. Anything short of that is a f'ing waste of time as Telkom will just reposition themselves yet again in a similar fashion to what they did with the bandwidth pricing structure.

There’s a healthy dose of pessimism for you but eish!!!

Telkom has noted the complaint lodged by ISPA with the Competition Commission. The Competition Commission will now investigate the matter and due process will follow. At this stage, Telkom cannot comment on the content or allegations made in the complaint."

I must be missing something... *All* they're doing is lodging a complaint that should have been lodged a year ago...? I hardly think thats a massive accomplishment, or something to celebrate.

That said, better late than never and I hope something comes of it.

seriously, jokes aside...

it doesn't matter when the thing is done, what matters is that it has happened. filing a complaint like this is not a question of writing an email. the ISPA is a body that has to fairly represent all ISP's - even those who use IS for their backbone.

let's get behind them and support them, not slay them for doing the right thing. at least the attempt has been made, and at least there is progress.

same with SNO - people are already calling it 'still not operational', and SNOT for Second NAtional OPerater TElecomms etc. just remember its a massive business that needs to be rolled out, and there's tons of work to be done before they can do anything.

for a change, let's not whine, let's look at the glass as being half full, as opposed to empty. let's get behind those that are doing something, no matter how slow. ICASA's draft ADSL regulations are great for the consumer, its taken a while but its on the table. if we support the process, it will happen faster.

These guys are filing the wrong complaint.

They should be taking on Telkom on the issue of International bandwidth, listening to the radio when the settlement was reached with the motor manufacturers they said that they couldn't take on the motor manufacturers on excessive pricing because none of them had a dominant market position.

It would be easy to argue that Telkom is abusing its position as the sole supplier of non-satellite bandwidth and charging excessively for the service it offers. I would think this would be an easy win. Anyone want to put in a complaint.
 
This complaint basically means nothing. Telkom has already been found guilty by the competition comission, and fined a couple of billion.

Telkom said the CC have no authority over them basically, and refuse to pay.. this happened a couple of years ago... whats going to change now?

They can file all the complaints they bloody well like, exactly what good does it do.
This is the net result of the anti competitve complaint against Telkom in 2004, and MaryJane kindly dug up the details in another thread on this forum.

Below are extracts from Telkom’s 2005 Form 20-F:

The Competition Commission found, among other things, that several aspects of Telkom’s conduct prima facie contravened the Competition Act, 89 of 1998 and referred certain of the complaints to the Competition Tribunal for adjudication. The complaints deal with Telkom’s alleged refusal to provide telecommunications facilities to certain VANS providers to construct their networks, refusal to lease access facilities to VANS providers, provision of bundled and cross subsidized competitive services with monopoly services, discriminatory pricing with regard to leased line services and alleged refusal to peer with certain VANS providers. Telkom has brought an application in the South African High Court challenging the Competition Tribunal’s jurisdiction to adjudicate this matter.

These matters and the amount of Telkom’s liability are expected to be finalized within the next year. If these complaints are upheld, however, Telkom could be required to cease these practices and fined an amount of up to 10% of Telkom’s annual turnover or be ordered to divest itself of the relevant business. Telkom is currently unable to predict the amount that it may eventually be required to pay. If Telkom is required to cease these practices, divest itself of the relevant business or pay significant fines, Telkom’s business and financial condition could be materially adversely affected and its revenue and net profit could decline.

These orginisations are mere irritations to Telkoms legal department.
At the profits Telkom churn out year on year, going to court is good business.

Only the DoC can effect any meaninful changes, and they know full well where their bread is buttered.

Still the wheel is turning, albeit slowly. Every complaint raised against Telkom strengthens the case against it. The first may lose, but the last will win.
 
Dont get your hopes up. Some years back the CC ordered that Telkom be fined 10% of its turnover for anti-competitive behaviour ... nothing ever came of it.

The "T" in Telkom stands for Teflon ...
