A racist comment made on Facebook landed a young HPCSA employee in hot water when she was arrested and charged with crimen injuria on Monday morning.

The woman, who cannot be named as she has not appeared in court, was arrested after she compared strikers to baboons and said they intimidated people with their grunting noises. She did not participate in the strike.

Warrant Officer Duane Lightfoot, of the Sunnyside police station, confirmed that she had been arrested and said she was still in custody. She will appear in the Pretoria Magistrate’s court on Tuesday.

According to Mike Ntloko, chairman of National Education Health Allied Workers Union (Nehawu), employees of the Health Professions Council of SA (HPCSA) embarked on a strike last week Friday for better pay and medical aid benefits. The strike is continuing.

Ntloko said he could not belive that one person could say this to another human being and he had personally opened the case against the employee.

“We want to prevent this (racism) from happening again and we want to make it clear that this type of behaviour will not be tolerated,” said Ntloko.

Bertha Peters-Scheepers, senior manager of PR and service delivery at HPCSA, said the organisation strongly condemned any form of racism.

In this specific matter, an employee was posting personal views on a social media network after hours, in her private capacity.

Peters-Scheepers said the HPCSA was currently investigating the matter and should the employee be found to have transgressed regulations, immediate action would be taken.

She added that the HPCSA had obtained a court interdict against the striking employees following acts of vandalism, sabotage, obstructing access to buildings, intimidation and assaults on customers.

These acts are also currently under investigation by members of the the SAPS.

Peters-Scheepers said the strike did not impact on the HPCSA’s ability to serve clients and that the number of strikers was fewer than 50 percent of the employees. - Pretoria News

Well I guess this is a clear indication of things to come. Also I do not see any racism in her comment. She likened the behavior of the strikers to Baboons, which in all fairness is quite an apt description.

IMO she likened the strikers to baboons (actions) rather than calling them baboons. In everyday language we relate to peoples actions in animals such as sly as a fox or he is slippery like an eel. If this was how she worded it on her account I can see the HCPSA paying a lot of money out for this case.

What will also be of vital importance to this case in my opinion, is WHEN she posted the comment on Facebook. If it was on HPCSA time, and at HPCSA offices, then they have a leg to stand on.. if she did it from home, then not so much in my opinion.

Also we can only really judge once we see the real comment as to whether there was any racism, because as its reported atm there is none.

Seeing certain people pee on the roadside whereever they want to, makes me think of far more colourful descriptions...

Reminds me of when old man CJ Langenhoven was still in parliament. He once stood up and said that half of the people in parliament are donkeys. A member of the opposition got up and protested and demanded that he retracted his statement. Langehoven said fine ..."Half of the people in parliament are NOT donkeys!!!"

Is it me or is being put in jail a step too far? I would really like to see the context of the comment cause this seems way over the top. Where is her right to freedom of speech?

Exactly. Compare a bunch of people to a bunch of animals lands you in jail, but singing songs about killing people from a certain ethnicity is OK.

This raises another question - why is she in jail? This is in conflict with the way SAPS are supposed to act. Only serious offenders and flight risks are supposed to be locked up.
As mentioned she wasn't directly saying they are Baboons.

I'd sue both Employer and SAPS.

I have seen people lose their jobs because of a comment on FB and then the race card is played (even though race was not mentioned). Only white people can be racist in SA..

Given there have been previous cases where racist comments have seen them in front of the HRC I would be very careful of what I said. It seems petty but I think the hardline is justified given how quickly hate speech can spiral out of control.

Incedentally, comparing this to Juju's Shoot the Boer case, what was the outcome of that trial?

I fail to see how this is a charge that somebody can arrested for. What happened to freedom of speech? The very same article goes on to list the damage and atrocities that the strikers committed. Frankly, if they don't want to be compared to animals, they shouldn't act like animals. I always have my doubts when I see someone is arrested for crimen injuria. It's just the scapegoat law that Police abuse to arrest you whenever they have no real reason.
