I would like to sell my old 1997 BMW 318is. It working fine with a couple of little things that I will decide whether to fix or not depending on the sale price. My question is this. How does the CPA act effect me selling my car privately? I don't want some idiot to run it into the ground for 2 weeks and then bring it back under the CPA act. I basically want to sell it voetstoets or something like that because the price will only be about R15k.

I think there's an agreement that is signed between you and the customer that says that he received it in good order (you should make a full list of things that are wrong/provide the roadworthy etc)

Then if he runs the thing into the ground and claims CPA and wants a refund or whatever, you can tell him to STFU. Not entirely sure this will work or not though. AFAIK most people are still uneducated about the CPA

If I am not mistaken, CPA doesn't. Apply. To private sales.

From a quick google it seems the CPA does not apply to normal private once-off sales, as has been said already.

Personally I would make a list of all defects and also include that the vehicle is sold voetstoots/as is, make sure you print two copies and sign both and if the person buys the car make sure they sign both as well.

Make sure you keep one copy safe.
