New LCD issues after 1month of use

Hi

I bought a Samsung 40" FHD LCD at their re-opening sale last year November 2011. Last Thursday the TV started acting up. It started off as a blur then a green line right accross the screen came up and also one from top to the bottom. we only started using the TV from 18 Dec 2011 and already having issues with it. only bought it there because of the sale. sigh. I posted it on hellopeter.com and i was contacted and advised that I need to bring the TV in so that they can send it away to Samsung to be checked out or fixed. I told the guy that phoned my that I want a new TV because its practically still "new". we hardly used it and he said that it needs to be sent away to Samsung. Doesnt CPA has something to say about this. Doesnt it protect the Consumer with this regards. I dont care what the SLA is between Game>Samsung. They told me it might take 1 wk to be sorted. Im taking the TV in tomorrow and will hear what they have to say.

Any advice.

Nothing in the CPA states they can't send it in for repair if you've had it longer than 2-weeks, sorry. :(

But that doesn't mean you can't make life as difficult for them as you possibly can, until they hopefully
give in.

Still, one thing you should definitely do, is make a note of your TV's serial number, to make sure they
don't try and give you a "refurb unit" in exchange.
 
9 times out of 10 they will give you a refund or replace the TV as they hardly repair LCD tvs. But it might take sometime.

I have read the entire long-winded CPA, but where (in the actual CPA), does it state that within the first 6-months YOU have a choice as to whether your item is repaired, replaced or refunded. I thought it was the store's decision.

The warranty provisions (sections 55 and 56) are far
reaching since, for the first six months after the date
on which a consumer has purchased a good, even if
nothing has been stated in writing, a 6-month warranty
is operational, entitling the consumer to expect that the
item is free of defects, can be used for the purpose for
which it was intended and that it will be durable for a
reasonable period. In the event that the good fails in
any of these respects, and the consumer is entitled to
choose to claim a new replacement good, be refunded
or have the good repaired. The choice is that of the
consumer, the supplier cannot dictate which of these
remedies the consumer must exercise.

It still seems a little foggy since repair or replace is on the same line: (56. (2) (a)&(b))

From what I've read there are only 2 choices for the consumer.

1. Repair or replace the defective product. (Supplier decides which one)
2. A refund of the full purchase amount.

So technically, you can't insist that they replace the defective item,
since option 1 is: Repair OR Replace.

But you can insist on a full refund, and buy something else.

Am I right or wrong here?
 
Took the TV in yesterday. Advised the store manager that I dont want the TV repaired; i want a new one. They swopped it for a new 1. THanks for the help guys; helped alot
