Johannesburg - An elderly Johannesburg diamond cutter who shot dead a man in a 2009 road rage attack has been found guilty of manslaughter, according to a report on Friday.

Magistrate George Andrews convicted Roy Wilson, 67, in the Randburg Magistrate's Court, Johannesburg on Thursday, Beeld newspaper reported.

Wilson shot dead Migel Balanco, 36, during an altercation in Linden, north of Johannesburg, after Balanco punched him in the face.

Balanco scratched Wilson's car and bumped his rear-view mirror while overtaking him on the night of March 22, 2009.

Wilson pursued Balanco, and the two became involved in a scuffle. Wilson, in self-defence, pulled out his firearm, intended aiming for Balanco's legs, and fired.

The court heard Wilson did not intend to kill Balanco. He however admitted having crossed the boundaries of self-defence and apologised to Balanco's family.

"There is no evidence that the accused intended to deliberately kill the deceased. The accused overreacted. He could have fired a warning shot, or warned the deceased that he had a weapon," said Andrews.

Sentencing was expected to take place in March.

Can help feeling for the guy , I mean someone knocks into you , rides on , you track him down and he then punches you. What do you do ? I mean the guy is 67 years old and the oke that punched him is 36 !! What kind of a guy punches a 67 year old in the first place ? I realise it was a very unnecessary death and I feel for the family but it was not intentional and one can hardly argue that the 67 year old should have aimed better ???
 
If that is the whole story, the old man was justified. Who hits a 67 year old? Its as bad as hitting a woman.
 
I wonder what he will be sentenced to? Hopefully (with mitigating circumstances) it will be a suspended sentence.

I'm just glad the road pig bled out in the street before he killed someone else with his mobile lethal weapon. :)

If there's one thing the internet has taught me, it's that you don't go up against 67-year olds, for your own sake :D

I still say lock him up. We obviously only hearing one side of the story.
What if Balanco was poor/retrenched and couldn't afford to pay to fix Wilsons car. ( I don't know the whole story just saying)

I understand the self defense part, but that is only necessary if the guys is trying to kill you not evade you.
 
The moral of the story is don't chase some one down, no good can come of it.

If they hit an run then you report to the police, there is no advantage to be gained by following the guy. If you catch up to him there is going to be a fight.

Well, the 36yo got what he deserved IMO. If you want to be an ******* get ready to deal with the consequences. a) He bumped into the old man without stopping b) he was the one who punched him in the first place. In JHB when that happens and you don't have any means of protecting yourself, that usually means YOU die. I believe it was in self-defense and "Andrews" should realize that firing a warning shot isn't the protocol and a myth when it comes to these types of things. Hell, I only watch SABC and have seen many programs of police officers stating that you do not have to fire a warning shot and that it's dangerous if you do because you never know where the bullet might end up.

HOWEVER, having said that, I feel gun violence was uncalled for unless the old man really believed his life was in danger (which I think it would have been, since we're dealing with an ******* here thinking the sun shines out of his ass), and combined with anger about what happened and how the young lad treated the situation (by a punch) I could understand... but he had enough evidence to file aggravated assault against the dude and get him locked up.

Rape is always a way worse punishment than death IMO

I suppose that we will never hear the other side as well seeing that the guy died but I must just state that Balanco did hit the 67 year old in the face , hardly trying to evade the guy. A punch in a 67year old guys face can also be seen as attempted murder. The man is 67 FFS. (Sorry not directed at you)
