President Jacob Zuma wants to review the Constitutional Court's powers, according to a report on Monday.
"We don't want to review the Constitutional Court, we want to review its powers," Zuma told The Star newspaper during an interview.
"It is after experience that some of the decisions are not decisions that every other judge in the Constitutional Court agrees with."
This was reportedly part of a democratic process to counterbalance the powers of the three arms of the state.
According to the newspaper, the issue was raised by a deputy minister and African National Congress leaders at the party's national executive committee meeting two weeks ago and was discussed by Cabinet ministers.
Zuma told the newspaper it was a "general societal issue" that was being raised.
He questioned the logic of having split judgements and said judges were being influenced by the media.
"How could you say that [the] judgement is absolutely correct when the judges themselves have different views about it?" Zuma asked.
He said that if decisions by Parliament could be challenged, there was nothing wrong with questioning the judiciary.
Democratic Alliance MP Dene Smuts called on Zuma to clarify his remarks.
"President Zuma will find that he is on the path to a full-blown confrontation with the Constitutional Court if his remarks really mean what they seem to mean, because the court itself decides the constitutionality of constitutional amendments," Smuts said in a statement on Monday.
"It is apparent from the President's remarks that irritation with some of the court's judgements lies at the root of the desire for review."

The constitutional court is not meant to balance anything. The constitutional court is the supreme authority in the land. When will these ****ing banana-republic goons begin to understand that?
 
I think JZ is concerned that he is going to see his butt, make his name g@t because of decisions and things he is, has and wants to do.

JZ are you concerned that some one is watching your every move and can over rule the k@k you create and cause every other day???

I think it was Richard Goldstone that recently warned about the meddling with constitution/concourt which would be very dangerous. Can't seem to find the article now.

So must there only be single judgment e.g that of the ruling party (ANC) and im sure the only influence he wants is that of his own or his pals.
 
Given that the judges often cannot come to a single unanimous decision wouldn't it be better to go the jury route?

Either way I don't think that's up to Zuma to decide.

No thank you. I don't trust laymen off the streets to decide my fate. In a country where people believe in witchcraft, tokoloshies and other crap you can bet your ass they will ignore solid forensic evidence in favour of voodoo etc, this schit even happens in the states.

Well he loves old Moegoeng which is ultra conservative and has issues with freedom of expression for the media etc.

Good point, in a criminal court of law at least. The bench should then be decided on by the public based on their experience in previous cases... Pipe dream, I know.
 
Meddle with the concourt... start a civil war Zuma. Thats how it works.

What does he actually do?

Generally he opens his mouth to change feet and lies about his shopping trips, but what does he actually do that might even remotely resemble work? I think the problem lies with the puppet-masters behind the Dbag. Are they not getting enough at the trough?

We did have a jury system though. But it was scrapped by the Nats in the 60s.

But I am very glad we don't have the jury system now. With all the racism in this country it would be a mess.

The Constitution is, as is pretty much any document written by Man, open to interpretation. What the hell does not all judges agreeing with a particular decision have to do with the validity of the judgement?

Huge portions of our population are illiterate and/or don't have a matric and you want a jury to decide on constitutional matters? :wtf:

Do that long enough and we will be back to idiotic crap like burning witches at the stake. You've seen the mob justice happening in our communities. You want those people deciding on the Constitution?!?
