Sold incorrect year model of bike,what do i do?

So I purchased a Yamaha yz 125"2007" in April 2011,and it turns out that the bike is a 2004 model,yet when the bike was advertised it said it was a 2007 model,I paid cash and even on my receipt it says Yamaha YZ 125 2007,even on the registration papers i was given by S4 auto it says it is a 2007 model,it did always bug me that it might not be a 2007 model but i never had the time to look into it,until I decided i wanted to sell the bike, for someone to point out that the bike was not a 2007 but indeed a 2004 because of the different features,so I said this can't be so i looked up how to read the VIN number,and the bike is a 2004 model,and i find this extremely bad from S4 auto,I in the 1st place have now overpaid for the bike and now cannot get a good resale value for the bike because i had been lied to about the year model,if it was a year margin it would be understandable,but i mean a 3 year difference?That is just ridiculous!

What can be done about this? or am i fighting a losing battle, i know the bike isn't worth a fortune, but it is about the principal of things, i have lodged a complaint on Hellopeter and that is about the best i can do for now, i see that they do respond. Please help out with some info.
 
Open a case of fraud at the police station. See a lawyer to write a letter. Send details to seller.

Will this just not end up costing me a fortune with all the fees etc. sorry don't know much about all legal things.
 
Go speak to them, tell them they made a mistake show them the paper work, and ask them to refund you the difference of value at the time you purchased the bike.

If they get stubborn, then speak to a lawyer, most will be happy to take it on if your paper work is up to date, as they will also sue for legal expense.

Take the cream as well, also claim for loss of performance for the features that you had paid for and did not get the enjoyment from.
 
If i were you i would contact the MD/CEO of the company and give him/her the oppurtunity to correct the mistake by compensating you financially that would cover the difference between what a 2004 model and a 2007 model would sell for. Give the company a set time frame in which to come back to you to sort things out. If they refuse to do so take it further, u dont have to go the whole legal route but just sending a lawyers letter to a company generally gets results very quickly if they know they at fault:)
 
Ok will do, all i have is the registration papers and then my reciept for what I purchased the bike for where it states also "yamaha yz 125 2007" is this enough? What are the exact steps to go about this, also all i am looking for is a refund, i'm not looking to score extra bucks from this, i just want my money back or what I would lose when i resell, i will make their life hell online, and hellopeter is a good place to start, also I read somewhere that S4 auto was actually on Carte Blanche a few years back for selling cars that had actually been in accidents as brand new, now i'm not stating that this is a fact just what i read, I don't want to be making rumours.
 
One thing, don't hide behind your online persona. Go and speak to them.
 
Ok so i phoned them now and i spoke to the manager, and he is like well if the paper said it was a 2007 then they accept it, so i said as a dealership how can you not go and check the vin number to see if the information matches this, so then he goes on to say that price i paid for the price back was equivelent to that of a 2004, and that there isnt at actually much of a difference between a 2004 and 2007 as offroads don't change much,where in actualy fact yamaha dide quite a bit of an upgrade to the offroads form 2005 onwards, but yet he goes onto say that what i bought the bike for was good value, and trying to avoid my point being that he sold me a bike that was not the correct year that it was made out to be.
 
S4 Auto are crooks and I will never buy from them again. I got sold a 2008 BMW and found out it was actually a 2007 when I traded it in. I just took the knock because after seeing that Carte Blanche story on them I just wanted to avoid dealing with them. I think they own Bruma Nissan too afaik and I stay away from that place too.
 
You need to get his response in writing. Send him a letter (without prejudice) stating only facts and ask for a response by a certain date. Explain that should the response not be to your mutual satisfaction then you will be left with no choice but to go the legal route...

yep they do ...they run few dealerships

and OP there bikes take a big knock since every year the bikes has new features and differences
 
Even if it IS a 2004 model, the date it was first registered is the date normally given in all documentation.
This means it was manufactured in 2004, but only sold in 2007.

My stepfather bought a car that was advertised as 1 year newer than what it was - and he only found a few months later when it went for a service and they mentioned it was the older model.

He went back to the dealer and pointed it out - but they were still slow in assisting. He brought up the fact it is fraud and he will pursue with the fraud case ... and they quickly changed. They checked the difference between the two year models in the dealer book and wrote him a cheque for the difference.

This is correct...

My bro bought a 2008 model R1, registered 2010, and all the documentation says 2010...

so price will be sold as a 2010 model ....where as theres a huge difference in power and handling and looks of the 2
 
There is a big difference between the model year and registration year. Dealers often blur the two intentionally to dupe customers. Registration year means nothing as far as I am concerned. Most motorplans etc. kick in on manufacture date not registration date.
