Bloemfontein - Western Cape taxi driver Jacob Humphreys is seeking leave to appeal against his prison sentence for killing 10 children in 2010.

He filed an application to the Supreme Court of Appeal in Bloemfontein on Thursday.

Humphreys approached the President of the Supreme Court of Appeal, Lex Mpati, directly for leave to appeal against the Western Cape High Court's judgment on the merits and sentencing.

High Court Judge Robert Henney sent Humphreys to jail for an effective sentence of 20 years imprisonment at the end of February.

He was convicted of murder following a taxi accident on 25 August 2010 at the Buttskop level crossing in Cape Town.

While taking children to school, Humphreys overtook a row of cars, ignored safety signals and proceeded over the tracks.

A train hit the taxi, killing 10 of the children. Four others were seriously injured.

Henney denied an application for leave to appeal the matter on the day of the sentencing.

Am I missing something - leave to appeal was denied but he is appealing ?

He is not appealing, he is seeking leave to appeal from a higher court. He is asking a higher court's permission to appeal. The supreme court cannot deny him, they have to listen to his request and make a decision whether to grant him leave to appeal or not.
 
So the judge denied him appealing, but he's going to the supreme court to appeal the denial to appeal.

Reminds me of someone else who always seems to have yet another way to delay justice.
 
He rather shouldn't. A higher court might just decide that the sentence was too lenient (which it is, in my opinion).
 
Only in South Africa are you denied leave to appeal, and then turn around and appeal.
 
Seeking appeal - I am sure he is just scared of all the peals waiting for him in jail, you blatantly killed people due to your careless attitude and now want to get of scott free - go f_ck yrself
