I am going to try and condense this post as much as possible, as the whole story is pretty long.
So 3 weeks ago I went to cash convertors, and noticed that they had 3x identical Coffee Percolators on sale for R399 (2nd hand),and I grabbed one, when I went home and cleaned some of the old coffee out of the machine and tested it,I found that it was leaking water, and appeared faulty.
I then returned the item to Cash Convertors, and asked to swap it with one of the other ones, we tested all 3 and they all where faulty with similar problems.
I was then told it would be sent to a repair center and would take approximately 3 days.
I waited the 3 days and went to collect the unit, while waiting for there "technician" I noticed the other 2 units were back on display, but they increased the price to R999.
The technician then told me my unit was "Unrepairable" :/ and that I "HAD" to take a cash refund.
I really didnt want a cash refund ,and insisted to speak to his manager to request it be replaced by one of the other units that is now fully working,as I cant understand that my unit out of the two could not be fixed as all of them had similar problems, and were identical.
I never took the refund, and just left the store with my receipt.
Later I went as far as to contact there "head office" to simply be told they have "No control over there franchises or there owners" and "its up to them to decide"
So here is my problem, I really want a working unit, I dont want a cash refund, and If I recall correctly according the consumer act it is up to me to decide if the unit gets "Repaired, Replaced or Refunded" if its in a valid time frame.
So do I have a foot to stand on by taking this to the consumer court,if so under what acts, who do I speak to?
PS lots of other things that I dont really want to discuss on here, like the owner of the franchise frettening on my voice mail box,but that's another story all together.
