Apple had a tactical edge over Samsung in court

American court favours a company with big bucks .. why am I not surprised.
 
Case was decided by an independent jury. I don't see much room for manoeuvre here. Samsung lost, accept it.
 
Blatant copying is blatant copying.

Stop resorting to cheap arguments like court bias.
 
One is that the Seventh Amendment to the U.S. Constitution confers a right to a jury trial in cases in federal court if the plaintiff is asking for an award of money damages, as plaintiffs in patent infringement suits normally do. Judges have difficulty understanding modern technology and jurors have even greater difficulty, yet patent plaintiffs tend to request trial by jury because they believe that jurors tend to favor patentees, believing that they must be worthy inventors defending the fruits of their invention against copycats -- even though, unlike the rule in copyright law, a patentee need not, in order to prevail in an infringement suit, show that the defendant knew he was infringing.

Now combine this with the fact that the lead juror is a patent holder and it becomes clear as to why exactly Samsung were found guilty.

The quote above is from an article by Judge Posner a reliable and experienced patent judge in the USA who wrote this article in relation to a trial between Motorola and Apple suing each other and was unfortunately not the one to preside over this case.

The problems with this case were clear from the start.Judge Lucy koh had made up her mind that Samsung were guilty before the case even began and therefore influenced the Patriotic all American jury to rule against Samsung because guess what....Apple is the richest American company in a very very very troubled American economy.

Which American would not want to keep one of their greatest assets right up there?

The case was by far a farce.A huge fail for the US justice system and it really makes you realise why the trial by jury method has been rejected by most countries world wide.

We not even on page 1 of this thread and already you feel it necessary to throw in the 'isheep' jibe. Shame man. You seem to be harboring quite a deep seated resentment towards folk loyal to the Apple brand.

Nope I say what I mean and mean what i say,i meant exactly what I said,I dont harbour anything,like i said it just doesnt make sense and strikes me a completely irrational how some people are carrying on for Apple as if they won something :confused: As someone that likes and owns Apple devices this really does baffle me...whats even more surprising lol is that two or three people that are isheep dont even own Apple devices...its truly fascinating how these people think.

What did we as consumers win by this?I only see losses for us the average consumer doesn't matter if you like Apple devices or other brands devices.A device is after all just a device.All this irrational Apple worshiping irritates me.

Samsung copied and sold devices cheaper because they had to innovate less with glossy plastics using someone elses OS (Android) and are seen as championing the consumer?
Apple innovates, brings the consumers what they want, charges more for the innovation and lack of cheap plastics and are successful yet evil and people who enjoy this are "isheep"???
These arguments are all over the place.

So what did you win by this?
 
Apple did not innovate as much as you try to make out, their cases were rejected in many countries.

They often seem to sue on prior art that they patented for themselves due to the broken USA patent system, as in this last case - but in the US you can get away with it!
