View Full Version : N70 on contract, what other recourse do I have?

Hopefully this is the right place to post this... I need some help and some unofficial legal advice please.

On the 3rd of July I got myself onto a contract which includes a free Nokia N70. It is the Everyday Weekend contract. Suits me fine, works out well.

The cellphone shop, Chatz Cellular at Princess Crossing, where I got it, told me that the phone would be there in 2-3 days after I gave them all the paperwork. By the 11th, I got fed up with hearing "the phone will be here tomorrow sir" when I phoned. I got hellopeter.com involved and was informed a day later by Vodacom that there is a problem with this handset. They told me that they are releasing stock on the 13th of July to various branches. SO I decided to wait and see..

Last week I see everyone (Game, Dions, Stax) is advertising the phone in the papers again, so today I decided to phone Chatz Cellular again, and got told "we ordered your phone today it will be here tomorrow sir, eish, software problems"

I know that they won't have that phone tomorrow, I am getting sick of this ****.

What can I do in a situation like this?

Has any monies be paid? If not cancel everything (do it all in writing, have them confim receipt / acceptance) and move to another channel / SP.

If money has been paid, get Vodacom involved, maybe some legal advice / letters from a lawyer.
Ask to be reimbursed.
Maybe dominic will have a better answer...
Tried hellopeter.com any further??

Have tried hellopeter.com again this afternoon, have made a new posting there. Still awaiting some kind of response. I also used a feature on their site to forward a copy of the complaint to the CEO of chatz cellular. I got his/her e-mail address from their website.

It is utterly ridiculous. Will wait to hear what dominic advises before proceeding with legal action.

I've been billed, the problem is the debit order is only going off next week but yes I received a bill in the mail, for July's subscription + connection fee.

I had the same problem,, i wanted to upgrade like a week ago to the n70, as evry1 told me " we will get it tommorow " i decided not a chance, intill i c any1 with one and vodacom confirms that they have one, i am also plannig to call them and ask to keep one out,, (mmm wonder if that is gonna happen)

A week before I got my contract my wife got an upgrade, they gave her, her N70 within 2 working days. Will send dominic a PM. Am also going to phone said shop again when I get to the office :mad:

EDIT: Got into work real late today thanks to the rioting on the West Rand. Phoned shop at 12h35, as they have not phoned me as promised. Person handling my contract is not in, again!

EDIT 2: Found Nashua Mobile has got stock of this phone and that the issue no longer exists. Have gone the hellopeter.com route again. Let's see what happens.

EDIT 3: Chatz Cellular staff got cocky with me on the phone so I phoned their MD. Julian phoned me and asked for my contract details and which phone it is. Then phoned by some chick in their accounts department and given another excuse i.e. they only got stock on the 25th. I told her that other outlets have got stock at which point she changed tack and offered to fax me their stock list and said she has got stock but she doesn't know what's what :mad:

EDIT 4: Not getting anywhere. PM'ed dominic. Am cancelling contract aswell.
