I am surprised that they only had 29 cases.

I also find the situasion desturbing, having a body that collects from all role players yet they are powerless is simply not acceptable.

At the end of the day they will favour whoever gives them the highest income and without clear rules of engagement the suffering will be done by the selective.
 
Larry Claasen, rpm, and Telkom customers please take note:

This is factually incorrect. When a person signs a contract with Telkom, the 'Standard Terms and Conditions" actually contain a clause where the customer is required to give up their rights to take Telkom to court.

The customer is forced to consent to arbitration, and the only instances in which a customer is 'allowed' (in terms of the Std terms and Conditions) to take Telkom to court is (I'm paraphrasing here) where the issue involves a complicated matter of law or exceptionally large amounts of money.

I laid a complaint with ICASA about this little trick that Telkom has written into their contracts. I laid the complaint in July 2005. The legal basis of my complaint is somewhat difficult to understand. Basically I am contending that this clause is unconstitutional because by submitting to arbitration procedures, the process and decisions which are (by definition) not open to public scrutiny, a person is FORCED into relinquishing a fundamental constitutional right as contained in the Bill of Rights (Chapter 2 of the Constitution). In other words, this clause is unconstitutional.

Where my complaint stands at the moment is unclear due to the fact that the SNO has been licenced and the ECA and IAA have been passed. To add to this, we all know how slow ICASA is....

The point of this post is to make customers aware that No, you cannot just take Telkom to court if you have a dispute with them that is unresolved by the Commission.

I took a month to month unlimited data contract from MTN, I paid 300 instead of paying R249, been sending emails, made calls & requested to cancel my contract but now they are telling me lots different stories, am no longer needing it & am no longer using it

I can't cancel, I have to pay cancelation fee, visit branch & when I go to the branch, they've told me that they can't help me because I applied it online
Why not pay the cancellation fee? It's month to month, but what did your contract say? Are you paying for a router, for example?
