COMPLAINT
In essence, the complainant submitted that there is a flaw in the PVR software that causes time-based recordings to randomly disappear, and you do end up missing your shows. This problem was brought to Mulltichoice’s attention more than six months ago, and the defect is yet to be corrected.
RESPONSE
The respondent acknowledged that there is a defect in the software that causes some time-based recordings to disappear from the time based recoding list. It further acknowledged that it has known about the fault for six months.
In light of the above, the infomercial ex facie promotes a functionality that it cannot currently deliver. This contravenes Clause 4.2.1 of Section II.
The respondent is required to:
* Withdraw the infomercial in its current format;
* The process of withdrawing the infomercial must be actioned with immediate effect;
* The process of withdrawing the infomercial must be completed within the deadlines stipulated in Clause 15.3 of the Procedural Guide; and
* The infomercial may not be used again in the future until such time as it can deliver the advertised service.
It is unnecessary to consider the remaining clause at this time.
The complaint is upheld.

This result is just weaselling out of their contractual obligations and 'benefits' only people who haven't yet been suckered into buying something that may or may not work ..and leaves out a legion of paying ^H^H^H^H^H^H conned, lied to and, sooner or later, mad as hell suckers who get the added 'feature' of "time recording (russian) roulette" to brighten their day.
