MNP "penalty" after contract expiry

I have a Talk120 contract with NashuaMobile. The 24 month contract expired in August/September. Now that I request porting, NashuaMobile calls me and want to charge a R900+ penalty because I did not give 3 months notice. I did not give notice because the same company cut of one of our MyBroadband members when he informed them of his intention...
Any ideas on the legality of this "penalty"? Shurely no good advert for this company

That can't be legal, on what are they basing the penalty? You're not locked in a contract and probably just going month-2-month ?

I mean if your contract expired and you didn't renew, then you have no obligation at all ?? I'm sure at Voda/MTN directly it's only 1 month notice if you want to CANCEL [after contract expired] .
 
For normal contract termination, continuing after the 24 months, many service providers (incl NashuaMobile) do require a 3 month notice. I consider it to be an unethical practise....
 
I don't really have anything to contribute to this thread, but my blood boils when I read crap like this!!
 
Well, this just sounds like NashuaMobile's daily operations to me.

They are not my SP but some friends / people that I know, and users on this forum, have reported so many unethical business practices from these guys.

I will never be linked to NashuaMobile. :mad:

They've been ok for me so far, but then I haven't tried to leave yet. :(
 
Having seen this thread, I meandered over to my service provider (MTNSP) to look for some Ts & Cs and I found the following info about International Roaming:

- If applying for International Roaming for the first time, a R500.00 security deposit will be required. This deposit will only be refundable 3 months from deactivation of the International Roaming and Unbarring service.

...

- After the normal 24 months contract has expired, 3 months termination notice period applies on all lines with International Roaming.

The "you must pay a deposit, which will only be refunded when the service is deactivated" stinks a bit, frankly. Are they going to pay interest for the time that they have the money? Riiiight.

I can *sort* of understand the second item, because roaming calls can sometimes take a while to reflect on an account, but still...

My proposed way to "beat" this:

* Apply for international roaming, and pay the R500.
* When you see it is active, immediately cancel the roaming.
* When you really need it, apply again. Since it's not the first application there should be no deposit payable.
* Ensure that you cancel international roaming 3 months before the end of your 24 month period.
 
Nashua Mobile refused to allow me to move my 084 number to Vodacom. I have now had to cancel it and take a new number from Vodacom.

Surely they can't do this? MNP says you're allowed to take your number with you!
 
I won't leave it there if I were you.

Take it further. Your contract has expired. There is no questions. e-mail the provider you want to go to and let them handle everything for you. They will surely know the legal side of this.

Nashuamobile can't do anything.

Funny enough, to add something else to this. My brother send a e-mail to Nashuamobile this morning telling them that he can get a better deal at MTNSP and that he thinks he should port to them. He got a reply from Nashuamobile telling him that the options are there and he can do as he wish.

I wonder if the person who send him the e-mail's manager/supervisor knows about this.
 
They keep on saying that Vodacom is not providing them with the correct info. They wait an hour and then decline it. 5 times so far.
 
My wife is with Nashua mobile and they are actually a bunch of cretins.
We have had many problems with them in the past and generally speaking, they are not very helpful at all.

I have also applied to have my Autopage SP Vodacom number ported to VSP on the Vodacom network and all seemed to be going well until I got a call from Autopage informing me that they were "not aware" of the Vodacom SP to Vodacom SP porting being active and that it has, and I quote, "caught them by surprise".............

This has been in effect since the 20th November and they have done absolutely nothing about it.
They are now indicating to me that they may be ready to port me from the 15th December but I have to call them back to confirm if they are ready.

African service on African time is all we seem to get these days.

That would be funny if it wasn't so sad. Can't Vodacom and the other networks force their SP's to comply?

I have no idea but as it stands now, I have no option but to wait until the 15th after which I will probably get some or other BS that will put another spanner in the works.....
