In a landmark Constitutional Court judgment a single mother found guilty of fraud had her appeal against a jail sentence upheld as the court took into account the interests of her children.
The court ruled on Wednesday that the woman, who cannot be named for her sons' safety, be released on a suspended sentence as the interests of her children had not been adequately considered in the lower courts.
She was convicted twice for fraud, the second time while out on bail on multiple counts of credit card fraud involving R29 000.
