How it all allegedly went down. A look at how the warrants were squashed and by whom and the continued maneuvering that seems to directly protect Selebi.

Space under Thabo's carpet must be limited and at premium these days.

Especially considering section 179(4) of our consititution explicitly states that:
“national legislation must ensure that the prosecuting authority exercises its functions without fear, favour or prejudice”.

Now there's no reason why thabo and his jsutice minister should not be setting overall prosecutorial and crime prevention policies of their choosing (they are after all the elected officials of the people responsible for this), but when they start interfering in the day-to-day running of the prosecuting authority at a specific case level it is cause for grave concern.
It would be indefensible for members of the executive to be placed in a position in which they have any say in individual prosecutorial decisions because we all know how easily they are tempted into shielding their chinas on the one hand and encouraging the hounding of their enemies on the other
 
There is a vote on the way, Thabo needs all the support he can get to run another term, come hell or high water.
 
All I can say is thank heavens we have a team like the Scorpions doing their stuff behind the scenes - I think we definately need more Scorpion training / teams run exactly the same way they are now.

I'm might be a bit confused but hasn't Thabo had his 2 terms already? Or have they changed that?

He wants to run a third term as president of the ANC. If he is elected, then he will effectively run the country anyway.
 
There is talk that he may change the constitution to enable him to run a third term aka Zim-style...

Either that or he'll put a puppet in place and pull the strings from behind the scenes Putin style. Is the limit 2 terms overall or not more than 2 consecutive terms? Still think it might be a better option than Zuma. :eek:
 
I just watched Deborah Patta demolishing the deputy director of the NPA. The one who is standing in for the former head.

(Not exact quotes)
Patta: "Did you drive around at night to the judges' homes to ask them to withdraw the warrants?"
NPA: "No"
Repeats question ...
NPA "I didn't go to their homes".
..
NPA "I went to their offices during the day"

...Eish, these lawyers are slippery or what !?!

He wont change the constitution he ony his recent imbizo (sp?) he was asked by people in KZN if he will change the constitution and he said he wont do it.

Mpshe has admitted publicly that the review of the warrants was by instruction from Mbeki himself. This would amount to direct interference in the -
day-to-day running of the prosecuting authority at a specific case level
- by the president.

Dodgy, its all about the semantics with lawyers.

I think the brief to the Ginwala lead commission needs to extended test the fitness of the Acting Director (MM) too.:p

A warrant of arrest does not lapse, it stays on until its been executed.

Why don’t you keep the warrant there, satisfy yourself and if there isn’t enough evidence, then withdraw it? Why did you have to withdraw it first if the warrant is never ending?

Why does the President know about all this in the first place? Surely he’s not supposed to have in depth information about who has made a plea bargain with whom.

Well, I’m just thinking maybe there was a briefing between the National Director and perhaps with the minister or the President.

DP:

I thought there was no briefing and that’s why they are upset and suspended the National Director.


MM:

Oh, then, that takes away my reason.

DP:

So, then how does the President know?


MM:

He can only know if he asked what was happening or if he’s been told.

DP:

So, for him to question those plea bargains, wouldn’t you deem that as interference?


MM:

I cannot comment whether the President is interfering or not.

DP:

Because you could lose your job

Putin? You think that whoever comes to power is going to let Putin control him? You don't know Russia or at least the USSR. Once Putin is out,
he's on his own and he's made a good few enemies in Russia and amongst the Russians abroad.
 
In what is now the primary thrust of the inquiry, Ginwala will have to determine whether Pikoli:

* in exercising his discretion to prosecute offenders, had sufficient regard for the nature and extent of the threat posed by organised crime; and
* whether, in taking decisions to grant indemnity to or enter into plea bargain arrangements with persons allegedly involved in organised crime, he “took due regard to the public interest and the national security interests of the Republic”.

This might be Mbeki's concern. If the national police chief gets nailed for crime it will be an international embarrassment and will start throwing eyes on Mbeki and his people who allow these appointments...


And then the scary bit... :eek:

Maseko insists that, from now on, government and the NPA will speak with one voice.
