Telkom could face R3.7bn fine

Note TELKOM deny nothing, they just argue that the authorities have, according to them, no authority to rule/judge or meter out any punishment towards them.

That's the first thing i've noticed too.. Telkom does not deny once that it acted uncompetatively.

I read it as " Yeah so we did it, and there's fsck-all you can do about it. Now run along..."
 
The mere fact that Telkodemonopolies still wants !CASA to take charge of this anti-competitive complaint, instead of allowing the Competition Commission & Competition Tribunal to do what they do best, is a sad indictment on !CASA itself: Telkodemonopolies knows exactly how incompetent !CASA is and that !CASA is never likely to reach a decision let alone fine the monopolistic beast ZAR1 or more.

Telkodemonopolies needs to be taught a lesson here - it is not above the law - contrary to what it believes and manages to constantly get away with - to the detriment of the whole country.

Even if ICASA did reach a decision, the maximum fine that they can impose is miniscule compared to what the CC can impose.

Maybe this is just a redistribution of funds from telkom -> whoever receives the fine...

I think the best way to implement this kind of fine would be to figure out the portion of the fine as a percentage of the profits or whatever and force Telscum to drop their prices by that percentage for a period matching the length of time that the offending behaviour went one.

It's a very good idea, and I would love to see that happen, having said that, any price regulations, would likely involve a large and very ugly !CASA-fly in the ointment :(.
 
man, I'd love to see them get slapped with this fine... That would be just a little justice for years of abuse and a good start to Telkom burning to the ground...

eltherza : Thats precisely why I think if the CC were to be actually useful, they would enforce the fine in such a way that it benefits the consumer rather than just being a large sum paid over which the manufacturer/provider just passes onto the client.
