Good people,

I need a debt collecting agency to assist me. Has any of you ever used such an agency with success?

I have a judgement (for debt) against someone and need to enforce it. It is supposed to be easy to do, since the court has already found in our favour and all that is needed, is to trace the debtor and have the sherrif serve him with a Section 65 notice.

How much is it that you want to collect and what is the share "They" can keep I can maybe help you out if the money is worth it ;)

Why go the Section 65 Route when you can just get a Warrent of execution and attach on the person's movable assets? You will most certainly get a the debtor attention then when the sheriff' pitches at their house?

Its a pity my firm doesnt do collections though.... tell me which area your debtor is in and i can recomend you a good attorney who doesnt charge a lot. i can also recommend a very good tracer.

The sad part: the case has been with an attorney for 2682048206026896 months now! (OK, I embellished a bit, but it has been a LONG time).

The sherrif was at his house. The debtor does not have any assets of note that can be attached and he rents his property. Pathetic little twit.

The attorney recommended we serve a Section 65 notice to get him to declare his income, explenses, etc.

He is married in COP and I would be happy if a garnishee order could be given against his wife's salary - even R 300 a month would suffice.

The debtor is in the Hurlingham/Parkmore area.

Ok so if its already with the attorney...why doesnt he get the S65 drawn up then and also has a tracer find the employment details??

Going the collections agency route is going to cost you a lot more thatn just getting the attorney who is already dealing with your matter to just have is secretary instruct a tracer and then draft the S65.

i'll pm you the name of the tracer agency we use, byt i have to warn you they do charge R500 Excl VAT for a trace and you would get the info you need within an hour or so...

They employed a tracing agent, who came up with ...................... nothing. Have you ever heard such nonsense in your life???? What is that thing they do for a living - FIND PEOPLE!!!!

You could try contacting WWstander (Or just Wstander?) can't remember which is which.

Ask them to buy the debt from you and then get your money immediately. That way they have to collect on the entire debt to make profit and its more, er, personal to them to squeeze the little **** out of as much bucks as possible.

Do you know where he/or wife is employed at? get the S65 to be served at his work since it will be his/ her work that will be implementing the garnishee order. And besides his employers salary dept have to accept services of the S65 if he is employed there.

No-one knows where (or if) the debtor is employed. I know where his wife works (nogal at a bank!).

Thanks, I'll give them a try. I was always under the impression that a debt like this one is too small for them to buy.

Oh yes, and I 'd like to watch while they squeeze their money out of him.

then sice they are married in community get it served on her..... simple as that and since she works at a bank even better.... means she earns a decent living and the banks' salaries department should be quite quick at implementing the garnishee....

We were told the S65 can only be served on the debtor personally - NOT on the wife, even if the marriage is in COP.

No you can have it done only thing is you will have to start the process al over again.... Summons, judgement etc....(all in the wife's name)
 
Meh, I have pretty much given up now.

I just checked his marital status on the DHA website and it says 'single'. Odd. So looks like - unless he gave us the wrong ID - we cannot pursue him via his wife.

He is one of those arrogant little upstarts, no conscience whatsoever. I hope he gets what he deserves. It will clearly not be from me, but from his very bad karma. He has a little baby girl, so you'd think he'd try to set an example and walk the straight and narrow, but his father clearly raised him as without any sense of responsibility.
