60Gig Promotion & The Consumer Protection Act

Does anyone know what recourse (if any) those of us who bought the 60Gig promotion have?

I'm gatvol and just want my money back

last i read the CPA only applies to contracts signed on/after 1 April.

The act has also been watered down in regards to mobile SPs. There was a thread about that a few days ago

The Department of Trade and Industry never published/gazetted the leniency for Mobile Service Providers. - So that no longer applies.
And the Whooosh! Product is an Internet Service Provider Product, and not considered by ICASA as a Mobile Operator Product.

All Smart Phones are a Combined Cellular Mobile Device & an Data Internet Device & a Computer Peripheral Device & Handheld PC Device.

If you have a pre-paid 60Gig Product, there is a way that you will receive a refund, as the "contract" conditions are that Cell C has contracted themselves to you, on a month by month bases. So, the contract for this month to provide you with 5Gig's of data began on the 1st April 2011, and lapses on the 31st April 2014 or until you have made FULL use of the 5Gig's data. This month, there will be a roll-over of the data, all things considered.

This case is with ICASA & the Consumer Protection Agency at this moment in time.

CPA is not retrospective, only applies from April 1 AFAIK

That's quite an odd interpretation of the contact, it is 12 months not month to month or it's once off with the understanding that you will get data every month for a year. Carry over is prohibited by the contract. The cpa will not apply on the basis you claim as you signed the contract before April 1.

One has to wonder how big a hit these companies are going to take when the CPA kicks in. I'm hoping it's a big hit towards better service.

Well i bought myself the 5gig/month, and i am gettin crappier speeds for the signal and strength i'm getting, btw, this is one of the "better" ones i've had... http://www.speedtest.net/result/1242016907.png
Maybe i should go back and CPA them, coz i did get this contract on the 1 April....
