Telkom to appeal R449m fine

Telkom says it will appeal the fine handed down to it by the Competition Tribunal earlier this month for abusing its dominance in the telecommunications market between 1999 and 2004. more
 
This is what big corporates do - tie things up in court as long as they can

WTH? Didn't they already appeal this for years before the fine was finally handed down?
 
Well no corporate would take this lying down. It's all about the money. There is nothing else for them. They abused their monopoly because they could and still am as bloody well far as they can. And it does not help that the gov is involved.

It might well be about VANS that will be suing Telkom and the money that Telkom stands to lose if those cases are won based on the Competition Tribunal's ruling and fine.

I seriously doubt that it is about the R449m which must pale in comparison to what Telkom must have spent over the years on delaying tactics in various courts trying to prevent the Competition Commission from referring the case to the Competition Tribunal.

What needs to happen now is that the Competition Appeals court orders that Telkom is split into two completely separate entities that have nothing to do with one another: wholesale Telkom infrastructure provider that cannot operate in any retail space; and retail no name brand thing that has to compete on an equal footing with other retail companies.
 
If I was Telkom, I would take the fine. The worst thing to happen is if you appeal, and then the originally asked fine of 3.5 Billion is passed down.

Telkom files notice of appeal against Competition Tribunal ruling

Telkom announced today that the Company has filed a notice of appeal against the ruling by the Competition Tribunal in the case between Telkom and the South African Value Added Networks.

Telkom will now have forty business days to file the record of appeal before the matter can be set down for hearing by the Competition Appeal Court.

“This is a very complex matter,” said Telkom Group CEO, Ms Nombulelo Moholi. “We have indicated our intention to exercise our option to appeal. We will use the next forty days to seek opinion from senior counsel and will evaluate our position before the expiry of this period.”

The ruling, issued on 7 August 2012, found that Telkom was in breach of sections 8(b) and 8(d)(1) of the Competition Act, Act 89 of 1998, imposing a fine of R 449 million.

Havn't you read the news. Gov is going to buy up Telkom now. It's official. So any fine will probably have to come out of zuma's wives shoe budget. If only... :/
 
The message seemed to be - we are definitely going to appeal, we don't know on what grounds yet but we have 45 days to come up with something.

I agree with Moholi that this is a 'complex' matter. They are probably looking for technicalities. Perhaps they intend to take each element of the decision-making which went against Telkom and to argue for bias.

Should be interesting to see the argument they come up with in 45 days, nevertheless.

I thought that was just rumour, yoh, im not surprised it is true. Will they also be De-listing Telkom from the JSE? Is there a link to any site I can read more about this Telkom-Government issue?
