Car Accident Advice

Hello, last week Thursday I was involved in a car accident. Long story short a Brand New Tiguan R came out of a side road without double checking and basically I swerved to avoid a head on collision leaving the whole side of my car wrecked.

I do not have insurance as I stopped it during Covid and was going to reinstate it later this year. Anyway that guy has insurance but he has been ignoring my calls and doesn't respond to anything. His radiator was leaking and his damage looked minor but my whole side is wrecked.

I'm unable to afford the repairs at the moment. I have his drivers license & also a police report. Would really appreciate any help tracking this guy since I need my car for work. I have taken my car for a repair quote and it came up to more than the cost of the car.
 
Final letter of demand giving 7 days notice, if no details of his insurance is forthcoming then lawyer up with costs and his insurance will not pay for those additional costs.

Also advise him that his insurer will not entertain a late notification of a claim.

Hopefully you get

Thing is I'm unable to get hold of him with the contact number he has provided.

This is stupid. Should not be on the road without insurance. Not much you can do but be at their mercy. Could try small claims court. Next thing is legal action it it is worth the cost.

Road accident fund? Long process though and not sure if it includes car repairs.

You cannot claim more that R15k/R20k from small claims.

A woman bashed my car's door and husband said they won't pay. My min. payment on insurance is R5000, so no use for me to claim as my excess will be more than the damage. Frustrating when poeple are so selfish. They have insurance as well.

Did you get his car registration number and ID details?
Was the accident reported at the SAPS?


I see you have a copy of his drivers license and the accident report.
If you at least have that it can be used to track the other party down.

Seem like you might have to get legal advice on this, but that will also cost money which you will probably never get back again.

Yeah people are crazy, Better to lower your excess to R1500 or choose no excess at all.
