Car accident advice

Sure you have a license now, he might also have one but the date of first issue will still be on them and will be before the date of the accident.
I hope you have not admitted to the lawyer that the accident happened, you might be able to say you didnt drive into him and that it remains up to him to prove you did. No case number, no witnesses...

The guy is trying with lawyer for 2 years now, doesn't want to give up... wonder how much he pays the lawyer...

I was recently sideswiped by an idiot that did not indicate, has no licence and also no insurance. R22 000 damage to the bike, my insurance paid and I paid the excess, three months later I have not seen a cent from the clown.

I have just been told by the insurance that if he can prove that he cannot afford to pay that they will basically then just leave it and take no action.

I personally hope this guy puts the screws in and both of you get nailed for not having a licence.

No witness, but there have been talks to him/lawyer.. does it count??

In that case deniability is out of the question as you've in all likelihood admitted that the accident took place. Without a lawyer to represent you, you might also have admitted guilt if you stated that you hit the car from behind.

Lawyer up...

You take time now and looky for lawyer. it muchy cheaper than to pay the biiiig money for the accident or you canna just hide away and change your living place.

Some one said it cost R3000 per appearance for the lawyer....

Yip, but the first consultation they might do for free, to assess the case, and importantly, to assess whether they have recourse to funds either from you or the other party...

Sorry guys, wrong info. actually it was reported to the police... I posted the thread on behalf of a friend...so...

Still, lawyer up regardless. How does your friend know that the other party does not have a valid driver's license, btw?

Also, has a civil case actually been brought against your friend yet?

when the accident was reported at the police station, the police sure asked them for licenses. so the other guy don't have license should be true.

Yes, I think the case is on, there is a case no. at the court. I think it's in pre-trial stage now.....

Well then your friend needs a lawyer asap. No need for questions...

Thinking? There is very little to think about. He needs to call Legal Aid immediately if he cannot afford a lawyer...

"Friend"...right.

Both he and I didn't have drivers license and both cars weren't insured.
Tough luck. Thousands die on our roads each year - I have little sympathy for you/friend.

Any advice on this matter?
Nope. Said "friend" is pretty thoroughly fckd. Not much point in sugar-coating it.

He is thinking doing this himself...
Dear god...

Look - this is going to end badly for you one way or the other. Having a lawyer gives you a shot at emerging from this with the least disastrous version of the possible outcomes.

By the way, who owns the car you were driving?
Judging by this thread...a mafia underboss..."Scratch it and you'll sleep with the fishes".

As everyone says "lawyer-up"

Maybe you hit the back of him because his brake lights were not working (on his unroadworthy car) & thus there was no indication that he had suddenly slowed down :D

Hi guys

I was involved in a accident 2 years ago. I bumped into a 99 Audi from rear, someone bumped to me as well from rear. It was on N1, and there was a standing still for some reason. The audi was said worthless to repair, so the guy is trying to claim R48000 from me. We are going through pre-trial at the moment. The audi guy is got a lawyer, but I don't.

Both he and I didn't have drivers license and both cars weren't insured.

Any advice on this matter? by the way, I tried to offer him R15000, he didn't want to take it.

YOU ARE AN EFFING IDIOT
