Hi Natedogg,
'act' would be a better description than 'be'. As per my response here ....

... the demand for priority traffic should be lower over the weekend, thus non-priority protcols (torrents & news) should be able to achieve best speeds (obviously we cannot guarantee line speed as this is influenced by many factors beyond our control).
MWB.
Hi MWeb, it bugs me that you keep misrepresenting the truth. Your package is SHAPED, 24/7.
Don't compare it to acting unshaped or whatnot, it is shaped. Period.
If somebody asks if your package is unshaped over the weekends, please answer: "No, it is shaped over the weekends".
Your analogy of "the needs of the many outweigh the needs of the few, or the one" is flawed.
When downloaders saturate your backhaul capacity they are not the only people that will be affected. you will be dropping any lower priority traffic like gaming, voip, "non downloading" peer to peer communication.
That is where shaped and unshaped differ. With true unshaped when the network becomes saturated you drop packets across the board, http, ftp, mail, and all the rest. So the impact to the "few or the one" is much less, while the "many" also suffer a small impact.
But I suppose this will still not stop you from trying to get people to think that your product is "unshaped" after hours.
