When your Tier 1 data is finished torrents are pretty much dead till 00:00 whereas HTTP is shaped and downloads will still work. So effectively you are bypassing the shaper by passing off what was p2p traffic, with almost zero output during daylight hours, to http which is merely shaped.

If you still have Tier 1 data left then there's no shaper to worry about bypassing.

Well, torrents are pretty much dead because they saturate and slow down a network & infrastructure much faster than HTTP downloads do, therefore they're the first to go. If you're downloading from a seedbox, you're not punishing the network as hard and therefore probably don't get shaped as hard.
 
Could you please share your technical analysis of the failed downloads with me so that I can discuss this with the news server provider?

I think you're seeing something you're looking for. Not something that's there.

I considered this and thats why I was hoping CW could clarify this point. As an ISP I'd rather have my users downloading from a seedbox than firing up a zillion connections to download their "content". I agree completely with you that it's much less strain on the network. But to be safe I was hoping CW would give their stance.

I paid a fee, and got a totally different level of service to what has been promised.

My requests for a pro rata refund are being flat out ignored, there is not even the backbone to refuse.

Wow. You accused CW of sarcasm. I said it wasn't there. You then thought I was referring to something else. So I referred you back to the alleged sarcasm.

Tweaknews may not have actioned the takedowns, or they decided to halt caching some new content until the new blocks filled up. I cannot comment on how Tweaknews work.

My post was not sarcastic. You categorically stated that we are lying, and I assumed that you therefore had information that made you believe as such, as this would be rather beneficial to us should it prove to be correct, as we also rely on a service provider for the news server. The provider however is the best in the country, honest in all interactions with us and their customers in the past, do not have a history of problems, but are always quick to resolve a problem where one may exist.

I believe we have been quite courteous with our replies to your accusations so far, and quite open.

Since you threatened us with legal action, your tickets are addressed by management. So the simple answer is "when management have the time to respond".

I thought the management (the CEO, in fact) answered my ticket to begin with?

I don't see why you're so surprised to see me assume you're lying - you blatantly lied to me when you convinced me that you can provide an uncapped 20Mbps service?
