The HP MINI came pre-installed with windows 7
Yes the anytime upgrade is where the problem was
 
Restore the PC to the original Windows 7 by using the built-in recovery partition. The Windows Anytime Upgrade feature will always retain the recovery partition during an upgrade. If you used another method to upgrade and destroyed the partition, then install Windows 7 using any Windows 7 DVD and the key that's on your PC's Windows 7 COA.

but if all else fails i will back up and restore

Sorry if this wrong, but I think the activation server for Windows XP has been discontinued. If you have a valid key you need to use a crack to get around activation ?
