The criteria I use usually includes that the software is licensed under a recognised open source license and they make the source code available. It sounds as though it is proprietary software which uses an open source component in this case.I've seen some people say that it's proprietary, but it seems to be built on chromium. Which I don't understand, unless some bits are proprietary which I guess it then disqualifies it for your list.
